ATV Crashes
ATV Four Wheelers can be dangerous and can easily cause life altering tragedies. The manufactures of ATV are in a perpetuated by a system that is still playing catch-up. The first ATVs for the United States Market was in 1971. It was for the 3 three-wheeler. The 3 Wheeler ATVs were involved in so many rollovers and injuries, the United States Justice Department filed a lawsuit on the behalf of the citizens of the UNited States against the manufacturers for violating the Consumer Product Safety Act. In 1987, the ATV manufacturers agreed to stop producing three-wheeled ATVs. Thereafter they started making four-wheelers to provide greater stability. Unfortunately they never recalled the 2.4 million defective three-wheelers that had been already sold from 1071 to 1987. We are now seeing the same or similar problems with the 4 wheel ATV. It appears that some ATV accidents are caused by manufacturing defects in the ATV itself, some for Warning Issues and some for Design Issues. "Manufacturing Defects" are flaws in the manufacturing process that result in injuries. "Failure to Warn" issues concern a situation in which a manufacturer knows of a hazard regarding the product and does not warn consumers about it. And "Design Defects" are errors in the product design that make the vehicle dangerous.
Across the Country individuals are standing up and winning Product Liability cases against ATV Manufacturers, and hundreds of thousands of ATVs have been recalled since 2000.
