San Antonio Zoo Sued After A Family Was Injured by a Fallen Tree Branch

Children under 14 are the most vulnerable age group for TBIs

San Antonio Zoo Sued for Over 1 million

A San Antonio family has filed a negligence claim against the San Antonio Zoological Society after a tree limb fell on them, causing their young daughter a traumatic brain injury (TBI) and leaving her in a coma for several days, according to a San Antonio Express-News report. According to premises liability law, businesses are required to ensure that their grounds are free of hazards for invitees and licensees. The claim filed by Librado and Crystal Rodriguez claims that the San Antonio Zoological Society was negligent in this duty and is, therefore, responsible for damages related to the accident.

Did You Know?

Traumatic Brain Injury (TBI) is the leading cause of death and disability for children and adolescents in the United States, with a shocking 50,000 to 60,000 estimated cases per year.

Traumatic Brain Injuries in Texas

Traumatic brain injuries don’t always occur during sports activities, though that is a common cause of TBIs in adolescents (20% of all TBIs annually). Traumatic brain injuries can occur from a simple slip-and-fall accident, as all it takes is a simple blow to the head to irreparably damage the brain. In fact, a TBI can occur as a result of a sudden blow to another area of the body, as long as it causes the head to suddenly jerk back and forth. TBIs come in varying ranges of severity from mild to moderate, but even if the injury is considered “mild,” it can still be an incredibly long and painful recovery process for the victim.

  • Mild – if the victim loses consciousness for a brief period or experiences extreme disorientation or dizziness, it is considered a mild brain injury.
  • Moderate – if the victim loses consciousness for several minutes to hours, or confusion and dizziness last for several days or even weeks, this is a moderate brain injury. Victims of moderate brain injuries can make a full recovery or at least live a fairly normal life with their new impairments.

Unfortunately, many victims of TBIs do not make a full recovery. Approximately 30,000 children under the age of 14 are permanently disabled due to a TBI every year in the United States, according to the National Library of Medicine. What’s worse is that many of these injuries, deaths, and disabilities as a result of TBIs are preventable accidents caused by another party’s negligent actions.
