How a Wrongful Death Attorney Can Help After a Fatal Hit-and-Run in San Antonio
Losing someone you love in a traffic accident is devastating. When the driver responsible flees the scene, grief mingles with anger and a flood of unanswered questions.
Who was driving? Will police find them? What happens if they never do? And how can the family pursue compensation without knowing who caused the crash?
Fortunately, you don’t have to wait for police to indentify the driver to ask for professional help.
Law enforcement will investigate the crime, but a wrongful death attorney can focus specifically on protecting the family’s legal and financial interests.
You Don’t Have to Wait for Answers Before Getting Help
A fatal hit-and-run investigation may take time. Some drivers are identified quickly, while others may remain unknown for months or longer.
But the family’s legal options do not need to sit still while the criminal investigation continues.
An attorney can begin preserving evidence, reviewing insurance policies, communicating with insurers, coordinating other available benefits, and protecting the family’s claim even before police know who was behind the wheel.
For a grieving family, that means someone else can start handling the practical legal work while law enforcement continues searching for answers.
An Attorney Can Conduct a Separate Investigation
After a fatal hit-and-run, police will work to locate the vehicle and identify the person who was driving.
A wrongful death attorney can conduct a civil investigation alongside that work.
Depending on the circumstances, that may involve:
- Locating and interviewing witnesses
- Looking for dashcam recordings
- Identifying nearby surveillance cameras
- Reviewing traffic-camera footage when available
- Examining debris or other physical evidence
- Working with accident reconstruction professionals
- Following up on information about the fleeing vehicle
This can be particularly important when witnesses remember only part of a license plate, the make or color of a vehicle, or the direction it traveled after the crash.
Even small details can help investigators piece together what happened.
Preserving Evidence Quickly Can Make a Major Difference
Some of the most valuable evidence in a hit-and-run case can disappear within days or weeks.
A nearby gas station, restaurant, apartment complex, or other business may have captured the vehicle on a security camera. But those recordings are often automatically overwritten.
An attorney can work to identify potential footage and request that it be preserved before that happens.
The same applies to witness information. Memories fade, people become harder to locate, and the scene itself changes.
Families should not have to spend the days after a sudden death knocking on doors or trying to track down video themselves. An attorney can take on that work while the family focuses on grieving.
What If the Driver Is Never Found?
An unidentified driver doesn’t mean that all hope of compensation is lost.
Uninsured motorist coverage may apply to certain hit-and-run crashes. Texas auto insurers generally must offer UM/UIM coverage unless the policyholder rejects it in writing, and the coverage can apply when the at-fault hit-and-run driver cannot be identified.³
For a pedestrian who was struck by an unidentified vehicle, an attorney can review potentially applicable policies to determine whether the deceased person qualified as an insured and whether the policy provides coverage for the loss.
That might include reviewing the victim’s own auto policy as well as other potentially applicable household coverage.
The answer depends on the actual policy and circumstances, so families should not assume either that coverage definitely exists or that they have no claim simply because the fleeing driver hasn’t been found.
An Attorney Can Deal With the Insurance Company for You
Finding insurance is only the beginning.
Even when coverage applies, the insurance company will investigate the claim, and likely will dispute the amount of damages, question whether particular policy provisions apply, or offer less than the claim is actually worth.
A wrongful death attorney can gather the evidence needed to support the claim and negotiate with the insurer on the family’s behalf.
That can include documenting losses such as:
- Loss of financial support
- Loss of household services
- Loss of companionship and society
- Mental pain and anguish
- Other damages available under Texas wrongful death law
Having an attorney handle those conversations also means grieving family members do not have to manage repeated calls, requests for documentation, and negotiations with an insurance company themselves.
What Happens If Police Find the Driver?
If investigators identify the hit-and-run driver, the criminal case and the family’s wrongful death claim remain separate.
Prosecutors represent the State of Texas and focus on whether a crime was committed.
A wrongful death attorney represents the family’s interests and focuses on whether another person’s conduct caused the death and what compensation may be available.
If the driver is located, an attorney can investigate:
- The driver’s auto insurance
- Who owned the vehicle
- Whether another insurance policy applies
- Evidence gathered during the criminal investigation
- Whether any other person or company shares responsibility
The family generally does not need to wait for a criminal conviction before exploring its civil options.
Crime Victims’ Compensation May Be a Last-Resort Resource
Families affected by a fatal hit-and-run may also qualify for the Texas Crime Victims’ Compensation Program, which includes hit-and-run offenses among potentially eligible crimes.⁴
However, CVC is generally a payer of last resort. Insurance, lawsuit recoveries, restitution, and other available benefits may affect what the program will pay.
If a family is pursuing both CVC benefits and a civil claim, the two should be coordinated carefully because a later insurance or lawsuit recovery may affect benefits already paid.
For eligible families whose losses are not fully covered elsewhere, CVC may help with certain qualifying expenses such as funeral costs or counseling.
