What Causes Single Vehicle Accidents in Texas?
A single-vehicle crash can happen for many different reasons.
Sometimes the driver makes a mistake. Other times, road conditions, another motorist, or a vehicle problem contributes to the loss of control.
That is why the fact that only one vehicle crashed does not, by itself, explain what happened.
Investigators have to look at the full sequence of events.
Speeding, Distraction, Impairment, and Other Driver Errors
Driver error is one of the possible causes of a single-vehicle crash.
Speeding, distraction, impairment, fatigue, and reckless driving can all cause a driver to lose control.
A driver may also misjudge a curve, react too late to a hazard, or make a sudden maneuver that causes the vehicle to leave the roadway.
When driver negligence causes a passenger to be injured or killed, the driver’s liability insurance can become relevant to a personal injury or wrongful death claim.
But driver behavior is only one part of the investigation.
Non-Contact Drivers
Another vehicle can contribute to a crash without ever making contact.
For example, another motorist may:
- Cut into the driver’s lane
- Pull out unexpectedly
- Force the driver onto the shoulder
- Cause the driver to swerve to avoid a collision
If the other vehicle leaves the scene, witnesses, surveillance footage, dashcam video, or vehicle data may be needed to determine whether it played a role.
Dangerous Road Conditions
The condition and design of the roadway can also contribute to a loss-of-control crash.
Possible issues include:
- Poor pavement
- Debris
- Missing or damaged warning signs
- Inadequate lighting
- Dangerous curves
- Poorly maintained shoulders
When a public roadway condition contributes to a serious crash, the responsible city, county, state agency, or other government entity may need to be investigated.
Government claims involve special immunity and notice rules, so these cases can be more complicated than ordinary car accident claims.
Mechanical Failures and Defective Vehicle Parts
Not every loss of control begins with the driver’s actions.
A tire blowout, steering failure, brake problem, or another mechanical issue can make a vehicle difficult or impossible to control.
Investigators may need to determine whether the problem resulted from:
- A defective vehicle part
- A manufacturing problem
- Poor maintenance
- Improper repairs
- Normal wear that had not been addressed
If a defective part or negligent repair caused the crash, a manufacturer, repair shop, or another company may share responsibility.
Multiple Contributing Factors
Single-vehicle accidents are not always caused by one clear mistake.
For example, a driver may be speeding when they encounter a dangerous road condition. A mechanical failure may become much harder to control because of the driver’s speed. Another vehicle may force a driver into a sudden maneuver that ends in a rollover.
Texas law can divide responsibility when more than one party contributes to an accident.
That is why a proper investigation looks at all of the evidence before determining what happened.
How Are Fatal Single-Vehicle Crashes Investigated?
When no occupant survives a crash, investigators must rely on physical evidence, witness accounts, vehicle data, and other records to reconstruct what happened.
Investigators may examine:
- Police reports
- Vehicle damage
- Tire marks and debris
- Vehicle event data
- Witness statements
- Nearby surveillance or dashcam footage
- Road and weather conditions
- Vehicle maintenance and repair history
- Evidence of alcohol, drugs, distraction, or excessive speed
Crash reconstruction professionals can also use physical evidence to help determine speed, direction of travel, braking, steering, and the sequence of events leading up to the collision.
Can Families Recover Compensation After a Fatal Single-Vehicle Crash?
Sometimes.
The answer depends on what caused the crash and whether another person’s or company’s negligent conduct contributed to the death.
For example, a passenger’s family may have a claim if the driver’s negligence caused the crash.
A driver’s family may have a claim if another motorist, a defective vehicle part, a negligent repair, or a dangerous roadway condition contributed.
In some cases, more than one party may share responsibility.
The important point is that a single-vehicle crash does not automatically create a wrongful death claim, and it does not automatically rule one out either.
The cause of the accident has to be established first.
What Compensation May Be Available?
When another party’s negligence causes a fatal crash, eligible surviving family members may be able to pursue wrongful death damages such as:
- Loss of Financial Support
- Loss of Companionship and Guidance
- Mental Pain and Anguish
- Loss of Household Services
- Other Wrongful Death Damages
- And More
No amount of compensation can replace a loved one, but a wrongful death claim can provide financial support and hold responsible parties accountable when negligence caused the loss.
