3 Things You Need to Know About Traffic Stops in Seguin

Nobody likes getting pulled over — it’s stressful, a little scary, and sometimes annoying. Most people know to conduct themselves respectfully and comply with officer directions. This blog will tackle lesser-known information regarding what police are allowed to do in a traffic stop and when you need a lawyer after getting pulled over.

Police Can Ask You to Step out of Your Car

Police are allowed to ask you and your passengers to step out of the car during a traffic stop in Seguin. You should never attempt to exit your vehicle unless the officer tells you to do so. Police are attacked and killed in traffic stops and will likely interpret your exiting the vehicle as a sign of aggression.

Police Can Perform a Pat Down for Weapons

If an officer has a reason to suspect you have a weapon, they are allowed to perform a pat down of your outer clothing during a traffic stop in Seguin. They are also allowed to take the weapon from you. They may also search areas of your vehicle that can be reached from the driver’s seat that may be concealing a weapon if they suspect you have one, like the glove box or under the seat.

Police Need a Warrant to Search Your Phone

Information on your phone is private and is treated similarly to your house when it comes to search and seizure laws. If an officer asks to see your phone in a Seguin traffic stop, you don’t have to show it to them. Also, information on your phone’s lock screen may not be used as evidence against you either — 4th Amendment laws also protect it.

Do I Need a Lawyer After a Seguin Traffic Stop?

If it’s just a simple traffic violation, you don’t need to talk to a lawyer about a Seguin traffic stop. However, if you are accused of a crime such as a DWI or drug possession, you need the help of an experienced criminal defense attorney to protect your rights.
