Can I Get Disability Benefits After a San Antonio Car Accident?

Normally, you expect to fully recover from an auto accident, but this is not always how things turn out.

We often talk about serious injuries on this blog — major car accidents can and often do lead to severe injury that results in you being unable to work or live the same way for years. Does that qualify you for disability benefits in San Antonio?

Benefits Through Disability Listings

Social Security considers a person disabled if they are diagnosed with a specific medical condition and meet the requirements of a disability listing outlined by the Listing of Impairments. Often but not always, injuries must affect the person for at least 1 year to qualify.

  • Fractures (Arm or Leg) — In addition to proving the injury with bone scans, an MRI, or an X-ray image, the injury must meet the requirements outlined by listing 1.22 or listing 1.23.
  • Back Injury — This includes injuries caused by auto accidents as well as pre-existing conditions aggravated by car accidents. Must include a compression injury to a nerve root or lumbar spinal stenosis as shown by an MRI to qualify.
  • Soft Tissue Injuries — This includes burns, gastrointestinal bleeding, and other soft tissue injuries outlined by listing 8.08, 5.02, and 1.21, respectively.
  • Traumatic Brain Injury (TBI) — As outlined by listing 11.18, the TBI must result in limiting your physical or mental capacity in an extreme way for at least 3 months to qualify.
  • Anxiety Disorders — Specific anxiety disorders that limit functional capacity may also qualify for disability if they meet the criteria outlined by listing 12.06.

Benefits Through RFC

If your injury doesn’t meet a listing requirement but still impacts your ability to work, Social Security will evaluate your injury and treatment.

After assessing your ability to perform basic tasks (standing, walking, sitting, lifting/carrying objects), the SSA will assign you an RFC of sedentary, light, medium, or heavy work. If you are younger than 50, you must receive an RFC for “less than sedentary work” to be considered disabled. If you are over 50, different rules apply, and you may be considered disabled for sedentary or light work, depending on your circumstances.
