What to Do If You’re Hit by a Car as a Pedestrian

Nothing beats unplugging for a brisk walk around the beautiful city of San Antonio. But if the worst should happen and you’re hit by a vehicle, here’s what to do about it:

  1. Get to Safety — If you’re able to, get off the roadway and to a sidewalk or other safe location away from traffic.
  2. Keep the Driver and Witnesses at the Scene — Did you know that it’s illegal to leave the scene of a pedestrian accident without reporting to police and exchanging information? While a driver will possibly not even be arrested for the accident (unless they were doing something illegal), they will be charged with failure to stop and render aid and arrested if they flee the scene. Encourage them and witnesses to stay until the police arrive.
  3. Call the Police — You are required by law to report an accident that involves injury to a person in Texas. If the driver tries to stop you or make you feel guilty for calling the police, calmly remind them that it is the law and that having a police report is in your best interest.
  4. Gather Witness/Driver Information — Get phone numbers, insurance info, and names from the driver and any witnesses, and take photos of the scene if you can.
  5. Seek Medical Attention — Even if you don’t think you’re hurt, go to a doctor just in case. Head injuries often appear later, and the damage may be irreparable by then.
  6. Call an Attorney

Expert guidance to help you understand liability and figure out how much compensation you’re entitled to is crucial after a pedestrian accident.
