The Zimmer-Biomet Bio-Medical Shoulder Recall

Many thousands of our fellow Americans undergo replacement surgery on their shoulder each and every year to relieve noticeable joint pain. A specific type of this surgery on the shoulder is called ‘reverse shoulder replacement.’ Reverse shoulder replacement is generally performed on patients who have totally torn rotator cuffs who then develop a serious type of arthritis in their shoulder called arthropathy. Reverse shoulder replacements are also performed on patients who present with previously shoulder joint replacement surgery which failed to work as expected.

In its efforts to capture a larger market share, bio-medical device manufacturer Biomet (now Zimmer-Biomet) claimed that its then new “Comprehensive Reverse Shoulder System” would be hailed as the “next generation” in “reverse shoulder prosthesis.”

However, the FDA announced a recall of Zimmer-Biomet’s Comprehensive Reverse Shoulder Implant on February 15, 2017. The FDA announced this is a class I recall. A class I recall is easily the most serious kind of product recall due to there being a “reasonable probability” that this particular bio-medical device will cause death or severe adverse health consequences. The official reason for this particular recall was that the “Comprehensive Reverse Shoulder” device fractures at a much higher rate than was stated in the product labeling. If such an implant fractures, the implanted patients may well need revision surgery to replace or remove it. If a patient has to go through a revision surgery, there is definitely an increased chance of death, infection or permanent loss of shoulder function.

Because of this particular recall, our attorneys at Carabin Shaw are now intensively investigating the general possibility and probability of success of lawsuits over Zimmer-Biomet’s “Comprehensive Reverse Shoulder.” Any patient who has been harmed by this “Comprehensive Reverse Shoulder System” may be entitled to compensation recoverable through a Biomet Comprehensive Reverse Shoulder claim and subsequent lawsuit.

The Zimmer-Biomet Shoulder Implant lawyers at Carabin Shaw have discovered that Biomet has already entered into a pre-trial settlement in one lawsuit involving its “Comprehensive Reverse Shoulder System.” In Alarid v. Biomet, Inc., et al., the patient/plaintiff had a reverse shoulder replacement on his left side with Biomet’s Comprehensive Reverse Shoulder in or about September 2009. An identical device was put into his right shoulder in or about 2010. However, within a few years of the surgeries, both shoulders failed, causing lost function and pain. Because of this, the patient/plaintiff had to have revision surgery to replace and remove the devices.

This specific suit was scheduled for trial in the Federal Court for the District of Colorado in February 2016. Zimmer-Biomet said doctors should continue to closely monitor patients who were implanted with the device subject to the recall but provided literally no additional patient monitoring instructions.
