Do not Avoid Service of Your Lawsuit

When being sued by a credit card company or debt collector, a lot of people think they are being smart or clever by avoiding the Constable or person trying to serve them with a lawsuit. This could really hurt you.

Alternate Service

If you successfully avoid service of your lawsuit, the attorney for the debt collector will get alternate service. This can come in a number of ways such as leaving the lawsuit at an old address or publishing the information in a random newspaper in town. If this happens, you'll likely never know.

Once service occurs through one of these steps, the credit card company can obtain a default judgment against you. This can harm your credit, prevent you from buying a home, or even freeze your bank account.

What Next?

If you know there is a lawsuit against you, you should work to answer it immediately. You can try to contact the person attempting to serve you. Further, the lawsuit is on file with the Court.
