Did You Know?
1,216 car accidents across Texas in 2024 were caused by a driver attempting to overtake and pass another vehicle without sufficient clearance.
Passing Safely: What to Know and What to Do After an Improper Passing Accident
Passing another vehicle on the road can be one of the most dangerous maneuvers a driver makes. Even experienced drivers must stay alert and follow the rules of the road to pass safely. Unfortunately, many crashes across Texas are caused by improper passing each year—and with Memorial Day Weekend bringing heavier traffic, it’s more important than ever to stay vigilant.
According to 2024 crash statistics, passing mistakes led to thousands of accidents across the State:
-
Overtake and pass with insufficient clearance — 1,216 crashes
-
Failed to pass on the left safely — 4,463 crashes
-
Failed to pass on the right safely — 1,993 crashes
-
Passed on the right shoulder — 823 crashes
-
Passed in a no-passing zone — 1,337 crashes
Let’s review how to pass safely—and what steps to take if a negligent driver hits you while passing.
5 Essential Tips for Safe Passing
-
Check your blind spots. Always verify there’s no car in your blind spot before changing lanes.
-
Ensure there’s enough space. You should have a clear path ahead and check for oncoming traffic or others trying to pass.
-
Use your signal. Clearly communicate your intention to other drivers.
-
Accelerate with purpose. Pass quickly but safely—don’t linger beside the other vehicle.
-
Return only when clear. Make sure there’s plenty of room before merging back into your original lane.
When You Should Never Attempt to Pass
-
Your view is blocked by a hill, curve, fog, or heavy rain
-
You’re approaching or inside a no-passing zone
-
A solid yellow line is on your side of the road
-
A school bus is stopped with flashing lights
-
The vehicle ahead is near the speed limit
-
You’re passing a long line of traffic
-
A vehicle ahead is turning or slowing down
-
Oncoming traffic is too close for a safe pass
What to Do If a Driver Hits You While Passing Improperly
Even if you’re doing everything right, other drivers may take risks that lead to serious crashes. If you’re hit by a negligent driver during a passing maneuver, follow these steps:
-
Call 911 Immediately
This is legally required if anyone is hurt or property damage exceeds $3,000. It also helps support your insurance claim. -
Move Off the Road Safely
If you’re able, pull over to a safe spot and notify the dispatcher where you’re relocating. -
Seek Medical Attention
Even if injuries seem minor, it’s best to let a medical professional evaluate you. -
Document the Scene
Take photos and videos of vehicle damage, injuries, the road, and the overall accident scene. -
Exchange Information
Get the other driver’s name, phone number, driver’s license, and insurance details. -
Report to Your Insurance Company
File your claim promptly—many providers require a police report for coverage.
