Man Killed and Children Injured in Wrong-Way Crash

A 22-year-old man is dead after being hit head-on by a wrong-way driver at around 1 a.m. on May 30, 2023, according to a San Antonio Express-News report. The 39-year-old wrong-way driver was arrested and charged with intoxicated manslaughter, as well as two counts of driving while intoxicated with a child under 15, and two counts of injury to a child causing bodily injury-reckless, as he had two children in the pickup with him at the time. All of them were transported to the hospital with minor injuries after the crash, and the 22-year-old died of his injuries at the hospital.

Injury to a child is a state jail felony punishable by up to two years of state jail time and up to $10,000 in fines. A child is defined as anyone 14 years old or younger by the Texas Penal Code.

Child Injury in San Antonio

Children are especially vulnerable to injury, and all adults have a reasonable duty to avoid harming a child (or any individual, for that matter). When a child is injured, it is especially devastating to their parents or legal guardian, and the emotions during this time can make legal decisions difficult. An injured child may be entitled to compensation for their injuries regardless of any criminal charges that may ensue. Some common ways children are injured in San Antonio include:

  • Auto Accidents – motor vehicle injuries are the leading cause of death and injury to children in the United States. Common injuries that children experience in auto accidents include TBIs, spinal cord injuries, bone fractures, bruising, and cuts and scrapes.
  • Unsafe Playgrounds – unfortunately, though these areas are designed specifically for children, more than 200,000 children are taken to the hospital each year for injuries on playground equipment.
  • Lack of Supervision – 818 children were reported to be seriously injured at daycare facilities in Texas in 2018. Lack of proper supervision is also a major contributing factor to children drowning, especially for children under five years old.
  • Sporting Activities – more than 3.5 million children are injured annually while participating in organized sporting activities. While these mostly result in sprains and scrapes, contact sports can often bring more serious consequences, such as TBI and broken bones.

If your child was injured because of the negligence of another party, you may be entitled to compensation. You can file your own claim, but it is not recommended without first consulting expert legal counsel, especially if your child was injured at school. Many schools in Texas are covered under sovereign immunity, so if your child was injured at school, it is essential to talk to expert legal counsel at Carabin Shaw to discover what options are available to you.
