Despite progressive legislation in several states, Marijuana is still very much illegal in Texas and Texas law can subject individuals to extremely harsh punishments. The Texas Health and Safety Code sets out the legal penalties for those individuals arrested for marijuana offenses. The punishment range for even a small amount of marijuana, zero to two ounces, allows for the possibility of jail.
