(November 2, 2022) Driving on Holiday nights is always risky when it comes to intoxicated drivers on the road, but this is especially true for Halloween night. Getting seriously hurt or losing a loved one is not the spooky most people expect on this festive occasion. Unfortunately, recent statistics found that drunk drivers were involved in 44% of fatal crashes on Halloween weekend. When not fatal, accidents involving drunk drivers almost always involve severe injuries like Traumatic Brain Injury (TBI) and Spinal Cord Injury (SCI), which can change the victim’s life forever. Fatal pedestrian accidents are also up on Halloween, and 23% of these accidents involved a driver or motorcyclist with a BAC of 0.08% or higher.

Spinal Cord Injury and Drunk Driving

Auto accidents are the leading cause of Spinal Cord Injury in the United States for those ages 16-30 and affect a staggering 450,000 people annually. They account for slightly less than half of all new cases of Spinal Cord Injury in the United States every year. Even more tragic is the fact that alcohol is involved 25% of the time. Additionally, half of these spinal cord injuries are complete, meaning that the victim permanently loses all feeling in the lower part of their body. Spinal cord injuries alter a person’s life forever – and the leading cause of this tragedy is an entirely preventable one. That’s scary.

An accident that left a man in his 60’s suffering injuries occurred on Tuesday night at a West Side intersection in San Antonio. According to the reports, the accident involved two vehicles, and it happened at the intersection of New Valley Hi Drive and Loop 410 access road. When auto accidents happen, there are two types of general damages. One of them being personal injury and the other property damage. Property damage claims can take time due to the insurance companies processing the claim at a slow pace. However, these types of claims are typically resolved fairly quickly. Some types of property damage and costs include the following:

  • Damage to your vehicle.

(June 28, 2022) Yesterday on June 27, 2022, three 18-wheelers collided with each other on I-35 South. The accident occurred Monday morning at roughly 11:22 a.m., on the southwest side of San Antonio on 1-35 South and Fischer Road, near Loop 410. The accident backed up traffic for hours, though it is unclear at this time what caused the accident, according to KSAT12. Images show one of the big rigs completely detached from its trailer, while another was rolled over on the side of the road. The final was a cattle trailer, which had jackknifed. There were no reports detailing injuries.

Accidents with 18-wheelers can be devastating. The sheer size and weight of a big rig can – and usually does – completely devastate a passenger vehicle. The injuries sustained as a result of an 18-wheeler accident are usually very severe and can include head trauma, broken bones, spinal fractures, and brain damage. Additionally, damages to the vehicle are usually very devastating as passenger vehicles are easily crushed by the immense force of a tractor-trailer. Unfortunately, accidents with 18-wheelers are not uncommon for Texans, especially along I-35. With the recent and rapid industrial growth of San Marcos, the “Innovation Corridor” meets San Antonio on its South and moves through Austin to its North. This has increased the number of 18-wheelers in that area – and subsequently, the number of accidents involving them. Accidents with commercial vehicles can be caused by numerous factors, including overloaded vehicles, distracted drivers, or traveling at unsafe speeds without the appropriate following distance (speeding and reckless driving). If negligence can be proven to be the cause of the accident, then there may be an opportunity to find mechanics and companies at fault as well as the driver. If you have been involved in an accident with a commercial vehicle due to the careless actions of the driver, you and your family may be entitled to legal compensation. Our law office has thirty years of experience representing the victims of 18-wheeler accidents in San Antonio.

On the Northeast Side in the 6100 block of FM 78, near Lakeview Drive, as per initial information, a single-vehicle motorcycle accident occurred, leaving a man suffering severe injuries on Sunday night. The victim was driving a 2007 Honda motorcycle northbound when his motorbike collided with a concrete median. The collision’s impact led to the rider sustaining severe injuries after the crash. Someone who witnessed this devastating accident assisted the motor vehicle rider and explained to the police what had happened. Reportedly the motorcycle rider was not wearing a helmet when the crash occurred. When the emergency personnel arrived at the scene, they hastily rushed him to a hospital with critical injuries somewhat after 9:15 p.m.

Determining who is at fault in a motorcycle accident can be challenging. Having an experienced and knowledgeable lawyer on your side is essential to help determine who is at fault. For example, you can sometimes lose control of your motorbike due to a manufacturing defect. The motorcycle’s front and rear tires must be aligned correctly in order to make the front end stable at high speeds and to avoid wobbling. If this high-speed wobble causes an accident, whether caused by poor manufacturing or negligent work done by a repair shop, those parties may be liable for injuries and damages. (June 16, 2022) Yesterday, on Wednesday, June 15, 2022, an adult care facility went viral after a TikTok video showed deplorable living conditions, allegedly being ignored by staff. KENS5 reported that this New Braunfels facility was shown to have moldy ceilings and human waste on the floor, among other things, that the staff claimed to be unable to take care of due to “privacy issues.” The residents of this care facility can have intellectual or developmental disabilities that do not allow them to properly communicate with the staff, according to the report. The company that operates the River Gardens Care Facility, Caregiver Inc., released a statement saying that the viewers of the videos did not have context and that their staff reacts swiftly to restore a safe environment. The statement also pointed out that the facility had received no deficiencies after its state audit last year. In an apparent contradiction, a former employee who spoke to reporters at KENS5, Peggy Martin, stated that she was not surprised it “had gotten worse” since her leaving the company last year. Additionally, Texas Health and Human Services told KENS5 that they were aware of the allegations against the facility and that they were actively investigating. The CEO of Caregiver Inc., Mark Lashley, stated that they would be working with their employees at the River Gardens Center to immediately address necessary repairs and restore a safe environment.

Assisted Living Neglect and/or Abuse in San Antonio

Nursing home neglect is an unfortunately common occurrence here in San Antonio. Most families cannot afford to provide the emotionally and physically taxing challenge of the round-the-clock care that the elderly and disabled need. When they turn to nursing homes and assisted living facilities, they believe that they are entrusting the care of their loved ones to experienced and trained professionals. This is not always true, as is the case in the above story. Common signs of nursing home or assisted living neglect are bedsores, patient depression or withdrawal, and unexplained marks, cuts, or bruises. We understand that each case is unique, so if you think your loved one may be the victim of abuse and/or neglect from an assisted living facility, contact an experienced attorney as soon as possible.
