What is Temporary Protected Status?

Temporary Protected Status (TPS) is an immigration status that is temporarily given to individuals who are unable to return to their home countries due to armed conflict, environmental disasters or other extraordinary conditions.

Once TPS status is granted to citizens of a country, they may remain in the U.S. and obtain authorization to work in the U.S. TPS status itself, however, cannot lead to legal permanent resident status in the U.S. When a country’s TPS status is stopped the alien returns to the same status they had before they held the TPS status.

Eligibility for TPS

For an alien to be eligible for TPS status they must show:

  1. Nationality of TPS country or habitually resided in the TPS country;
  2. Physically present and continuously resided in U.S. since designation of TPS;
  3. Must be admissible into U.S.;
  4. Not ineligible due to conviction of felony or two or more misdemeanors; and
  5. Registered for TPS within time allowed by Attorney General.
