Who is at fault in an auto accident in San Antonio?

Personal Injury and Negligence law varies widely between States. Texas is an “At-Fault” State, as opposed to a “No-Fault” State like Florida or Pennsylvania. This means that any driver who is either completely or at least 50% responsible for an accident must take legal responsibility for it. To recover damages from the responsible party, the plaintiff must prove that the other party is at least 50% responsible for the accident. That is why it is important to call the police, or if the police cannot come to the accident site, to go to the police station and file a report if you have been in an auto accident in San Antonio. Our experienced attorneys at the Law Office of Carabin Shaw have nearly 30 years of experience dealing with big insurance companies here in San Antonio. If you think you have a personal injury claim, it’s important that you contact a reliable firm as soon as possible.

(Monday, March 28th) A fatal single-vehicle rollover crash occurred leaving a 4-year-old child deceased at the scene. The Boerne police were dispatched at 2:13 p.m. The accident happened on eastbound I-10 near mile marker 539. An initial investigation revealed that the driver of the black SUV was unable to control the vehicle and overcorrected, causing the SUV to roll repeatedly.

The SUV had three passengers and a driver, the driver was an adult female, and the passengers were an infant, a 2-year old child, and a 4-year-old child. The Initial investigation revealed the children possibly weren’t appropriately restrained in their child safety seats. Unfortunately, all of the children were ejected from the car when the crash occurred, some of them suffering fatal injuries. The 4-year-old was declared dead at the scene by Justice of the Peace Michelle Van Stavern of Precinct 1. The other three who sustained injuries were rushed to University Hospital in San Antonio for medical attention.

When the right conditions exist, any vehicle can rollover; however, SUVs and vans are most likely to suffer from these types of dangerous collisions. In the United States, SUVs are being bought at a higher rate than any other type of vehicle. In a city like San Antonio, where there is a high concentration of traffic, such a crash can cause multiple injuries or even death if one of these big vehicles flips or rolls over.

(Sunday, March 27th) Just after midnight near SE Military Drive, a deadly accident occurred involving an intoxicated driver, as reported by Fox News. Police reported that the driver of the 2006 Chevy trailblazer swerved into oncoming traffic, striking a 2004 Buick Rendezvous. As a result of the head-on collision, the driver of the Buick, a woman, was ejected from the vehicle. Unfortunately, she was pronounced dead at the scene. The driver of the chevy had to be cut from the vehicle by the local fire department and was taken to the hospital in critical condition. It was there that he was found to be intoxicated, and the police reported that he would be booked by proxy for intoxication manslaughter. There was a passenger, another woman, in the now-deceased woman’s Buick. She was injured but in stable condition at the hospital. The road had to be blocked off for several hours during the investigation and clean-up.

Drunk Driving in Texas

The Center for Disease Control and Prevention (CDC) reports that 29 people die every day due to an intoxicated driver in the United States. This is the equivalent of one death every fifty minutes. The State of Texas has some of the highest rates of accidents involving impaired driving in the country. The Texas Department of Transportation reported 813 fatal crashes and 914 fatalities caused by impaired drivers in 2020. Drunk driving comes with serious consequences and affects thousands of people every year. A tragic accident with an 18-wheeler took place at 12:30 A.M. this morning on I-37 in South Bexar County. The accident claimed the life of one individual and left the other in critical condition, as reported by KSAT News. The truck driver sustained no injuries; however, the impact pushed his vehicle into a nearby ditch. The other vehicle sustained significant damage, and the highway was closed temporarily to clear the debris. The cause of the accident has not yet been reported, nor have the names of the victims.

A collision with an 18-wheeler often has tragic consequences. Due to the sheer size of the vehicles, even a collision at low speeds can result in severe damage and injury. Combine this size and strength with Texas highway speeds, and the result is devastating. Victims of commercial vehicle accidents often sustain major permanent injuries, such as brain damage and extreme disfiguration. Unfortunately, it is often the case that victims of a commercial vehicle accident tragically lose their lives, as in this case. The law office of Carabin Shaw has been representing victims of 18-wheeler accidents for nearly 30 years in San Antonio and the surrounding area.

A man was killed in a horrific three-car accident early Monday morning on the southwest side of San Antonio. The driver was allegedly heading southbound and lost control of his vehicle, causing him to collide with a passenger vehicle and the rig of an 18-wheeler heading northbound. The driver was immediately rushed to the hospital with significant injuries, including several broken bones and internal injuries but was pronounced dead hours later. The drivers of the other two vehicles were not seriously injured. Detectives are unclear what caused the driver to lose control. However, the crash happened right around the same time it began to rain, and they suspect that may have contributed. The accident occurred around 5 am on Monday, January 31, just off New Laredo Highway near Briggs Avenue.

Roughly 3,000 people die on Texas roadways every year. The Center for Disease Control and Prevention (CDC) reports 4.9 billion total costs of motor vehicle fatalities in Texas every year, with 2.9 billion or 46% being young adults ages 20-34. Fatalities on Texas roadways are a severe problem that affects thousands of families every year. At our firm, we understand that these are people, not just another statistic. They were brothers, sisters, husbands, wives, and children whose families were left to mourn and grieve. Fortunately, the Law office of Carabin Shaw has the tools and resources needed to help.

A man tragically lost his life early on Friday morning. He was on the city’s far West Side when this single-vehicle accident occurred. According to initial reports, the fatal incident occurred at roughly 1:30 a.m. in the 1200 block of SW Loop 410 on the access road headed southbound, nearby Loop 410 and Marbach Road. After driving over a puddle on the street, the driver lost control, and the 2004 Mustang crashed into a utility pole, a fire hydrant, a tree, and a drainage culverts metal railing. The Mustang flew over the metal railing and landed on its roof. The driver, unfortunately, did not come out unscathed from this accident. He received fatal injuries, and officials declared him dead at the scene. Reports say a passenger in the Mustang suffered minor injuries.

In accidents such as this one, the manufacturer of the car may be held liable. The reason is that in the car’s production process, the parts used can sometimes be dangerously poor in quality. At Carabin Shaw, we’ve seen time and time again defective product lawsuits overlooked in an auto accident due to ignorance of knowing how to determine a potential claim or potential defect in the product. It’s often the case that unless an experienced injury attorney, qualified investigators, and product experts are involved early on in the process after a car accident, those claims go unnoticed. Instead, driver error is commonly determined to be the cause of the incident. Product liability claims are, in some cases, never even investigated. In our experience, a highway collision involving death or severe injury needs investigating and reviewing as a potential crashworthiness claim or product defect claim.

There are a vast number of product liability cases involving automobiles. In instances where the possibility of a product defect in an accident could be, an investigation into the matter should go underway. Here are some instances:
