Background on the Defects in Takata Airbags

Once put on high alert Because of GM’s until that point unprecedented issuances of auto and truck recalls which started in 2014, the Federal NHTSA (National Highway Traffic Safety Administration) issued a federally mandated “consumer advisory” to all registered vehicle owners who could be impacted on Oct. 22, 2014. Lawsuits were also filed. Among other firms, Carabin Shaw’s San Antonio Defective Takata Airbag Lawyers have filed “products liability” actions against the airbag and vehicle manufacturers. These lawsuits were undoubtedly part of why Takata should have issued the recalls and the manufacturers took steps to cut off future lawsuits with by issuing their recalls.

This advisory strongly urged vehicle owners in climates with higher average humidity, such as Puerto Rico, South Carolina, Florida and other areas along the Gulf of Mexico coast to act immediately and fix their airbags because the defect may relate to long term exposure to humid, hot environments. The actual number of fatalities which have been linked to Takata airbags which were defective went up to five on or about Nov. 13, 2014. This followed reports of a Honda driver in Malaysia dying shortly after her airbag, made by Takata, exploded.

On or about Dec. 3, 2014, officials at Takata refused any expansion of their recall. This was despite strong requests coming from NHTSA. However, at least three entire vehicle manufacturers did voluntarily expanded the recalls of their vehicles which contained Takata products:

  • Honda increased its recall to those vehicles affected to those in all 50 states.
  • Ford expanded its vehicle recall to those affected by Takata products to all 50 states.
  • Chrysler issue a recall of even more of its 2003 Ram 1500, 2500 and 3500 light trucks which were ever registered or sold in the U.S. Territories of the Virgin Islands, Saipan, Puerto Rico, Guam, American Samoa and the states of Texas, Mississippi, Louisiana, Hawaii, Georgia, Florida and Alabama.

In response to the changing conditions and worsening liability climate, in May of 2015, Takata finally issued a recall. It announced that about 33.8 million vehicles may well have defective airbags installed which may suffer and explosion of excessive force, causing death or serious injury by shooting metal fragment and shrapnel at drivers and passengers. Takata even admitted this happens sometimes even when no visible or detectable deployment of the airbags has happened. When Takata made this particular announcement, it also entered into a consent court order with the NHTSA which covered its responsibilities and obligations during the recall process. Takata also released several reports of defect information setting forth the exact details related to the affected devices. The official estimate of vehicles affected was adjusted at a later date to about 23.4 million by NHTSA. This was "based on the most accurate and recent information given by the automakers affected, and includes an additional 4 million cars and light trucks which have already had repairs done."

On or about May 4, 2016, NHTSA expanded its recall to approximately 40 million faulty airbag inflators. This was on top of the 28.8 million already recalled inflators and increased the number of recalled vehicles in our country alone to about 70 million. About 100 million vehicles have been subject to recall worldwide. The different phases of the actual recall are supposed to place in stages up until December 2019.
