On or about May 19, 2015, the NHTSA Administrator and the U.S. Department of Transporation Secretary announced that Takata had itself declared that at least 33.8 million vehicles manufactured by at least 11 different makers defective. This just about doubled the U.S. Takata recall number of 17 million vehicles. NHTSA employed researchers stated then that this is the largest auto recall ever in the U.S., but is also possibly the largest consumer product recall in U.S. history. The officials added that NHTSA itself was establishing a program to test Takata airbag inflators. They did however, say that the installation and development of a safe replacement part may well take years to complete. Officials said that this was the most complicated consumer product safety recall in American history. Takata Ordered Stop Using, Over Time, Ammonium Nitrate Propellant

On or about Nov. 3, 2015 Takata was fined about $70 million. There was also an additional possible $130 million penalty to be assessed if Takata failed to obey the orders issued by NHTSA. These orders included appointing an independent monitor for safety. If the fines were all imposed, the total of $200 million would be the largest DOT issued civil penalty history. Takata was additionally ordered to phase out the sale and production of airbag inflators which use ammonium nitrate as a propellant.

On or about Jan. 13, 2017, the Department of Justice released the information that Takata’s lawyers had agreed that it would plead guilty to one felony count of wire fraud and pay the government $1 billion in total criminal penalties. The Federal Judge presiding as appointed retired FBI Director Robert Mueller to administer and oversee a Takata Victim Compensation Fund as one provision of Takata’s settlement with U.S. DOJ.
