It is a sad truth: Your usual lawn chair from the neighborhood Wal-Mart is actually more strongly built than most of the seat back assemblies in passenger vehicles our American highways and roads. Defective and failed seat ratchet mechanisms and car seat backs have caused death, lifelong disabilities and other serious injuries.

The Consequences of Defective Seat Backs Failing

Even low speed, relatively minor accidents can, and often do, cause failure in vehicular seat backs if the construction materials used to build them are not adequate. If there is any kind of accident, the mechanism which holds up the seat and its back portion can break, which throws the passenger forcefully backward. In very minor accidents, even this can cause whiplash or serious injuries to the back. At higher speeds, unfortunately, this failure of the seat back can often result in horrific spinal cord, back and head injuries. Proving the extent and causation of serious injuries is serious business. You need a law firm with long standing relationships with the right medical professionals to treat your injuries and the right ones to testify in Court. The San Antonio Vehicle Defective Seat Injury Lawyers at Carabin Shaw have these relationships. We can, and have, proved up complex medical causation for serious injuries. This is the most important step in getting you a full and fair recovery. Take advantage of our years of experience and relationships with doctors and put them to work on your case. Contact us as soon as possible after your accident to get your treatment and case started.

Most of these failed seat backs happen because of and during rollover and rear-end accidents. As intended, the seat should restrain the occupants into maintaining an upright, secure position. If, and when, the seat assembly, including the seat back, fails, individuals can:

  • Suffer death or severe injuries and/or cause passengers in rear seats behind the failed seat severe injuries or death if, and when, the front bucket type seats fail and collapse
  • Suffer a loss of control of their vehicle if they are unable to remain upright, which loss of control can cause additional damage
  • Collide with structures inside the vehicle or impact other passengers who are riding within the vehicle
  • Get completely or partially completely ejected away from said vehicle, which ejection greatly heightens the odds of death or catastrophic injury.

On top of all of that, if a defective car seat system fails, the other restraint systems for passengers are frequently reduced to being completely ineffective. Such systems would be the air bags and/or seat belts. The Vehicle Defective Seat Injury Attorneys in San Antonio at Carabin Shaw are quite familiar with how defective seats can and do compromise other passenger and driver safety systems during a vehicle accident. Proving this takes good evidence and effective testimony. We have an ongoing working relationship with the right expert witnesses to prove this complex type of causation and get recoveries for our clients. Give us a call today and let us get started on your case.

The National Highway Traffic Safety Administration (NHTSA) has requested and petitioned the rest of the government many, many times to issue updated seat safety standards, which would require that seats only have to not fail during a test pull of 3,300 pounds per inch of applied pressure. Based upon its own crash tests and its own rating systems, the NHTSA is actually recommending to the federal government that it increase these as yet unadopted safety standards to 20,000 pounds per square inch. This would be a much more realistic amount of force to withstand in a rollover or significant rear-end type collision.

Sadly, despite NHTSA’s efforts, pressure from the auto industry has meant that the safety standards have remained unchanged. If you have suffered accident related injuries which were caused or made worse by a defective vehicle seat, call the Vehicle Defective Seat Injury Attorneys in San Antonio at Carabin Shaw. We are here to help you. We take our injury cases on a contingent fee basis and thus will only get a fee if you get a recovery.
