In response to lawsuits such as those filed by the San Antonio Biomet Hip Lawyers at Carabin Shaw, the company has faced more than 1,000 claims and lawsuits which involve its M2a-38 and M2a-Magnum and replacement hip implants. In or about February of 2014, Biomet, Inc. agreed to a payment of $56 million to facilitate settlement of hundreds of these cases. The Plaintiffs filed lawsuits alleging that the hip replacements, because of their metal-on-metal type design, is allegedly defective because particles of chromium and cobalt, both toxic, can “shed off” of the implant and into the patient’s hip. When this happens, it can result in severe and serious pain, the implant’s failure, and needed revision surgery to correct the problem. Carabin Shaw’s San Antonio Biomet Hip Lawyers are currently filing lawsuits against Biomet on behalf of those who have suffered damages from these allegedly defective medical devices. Call us today if you have had one implanted and you have any problems with it.

What actually is a Biomet M2a-38?

The Biomet M2a-38 is a replacement hip of metal-on-metal design which is made from cobalt and chromium. This particular design was orginally planned as a replacement for other types of designs of artificial hips because it was supposed to last longer and give the patients a wider range of motion and more flexibility in the hip.

What exactly is the problem?

The entire concept of Metal-on-metal designs for hip implants has become controversial after a number of studies discovered that these replacement hips had risks, unique to this design, which were in addition to the already existing risks of other types of hip implants. The basic problem is the grinding together of the metal pieces which happens every time a patient moves. This metallic friction may generate tiny particles of cobalt and chromium which can “flake off” and build up in the patient’s hip joint.

The Cobalt debris is made up of ions which are soluble in water and can, and do, leech into the patient’s bloodstream and cause a metal toxicity called metallosis. Metal bits or debris present in the patient’s hip will also cause soft tissue growths, bone death, inflammation, swelling and pain, and other bad side effects which can contribute to the implant’s premature failure. When these kinds of complications happen, almost all patients need surgical revision.

Class Action Information about Biomet Hip Implants

Carabin Shaw’s Biomet Hip Attorneys in San Antonio are currently filing these lawsuits. As stated above, Biomet Inc. has agreed to pay out $56 million for compensation and fees to the attorneys to settle hundreds of pending lawsuits which involve the Biomet M2a-38 and M2a-Magnum metal-on-metal designed and built hip replacements. This settlement, basically, would make a payment of about $200,000 for each plaintiff who qualifies, although larger awards may be approved in certain cases.

Additionally, there are lawsuits which are not part of any class action against Biomet, Inc. Instead, at least 1,000 individual damages lawsuits have been transferred to a federal Multi-District Litigation (MDL No. 2391) panel in the U.S. District Court for the Northern District of Indiana for centralized discovery and pre-trial handling.

What is the problem?

We are filing individual claims and then lawsuits on behalf of each of the women and men who developed serious complications from these metal-on-metal replacement hip implants. These complications include revision surgery, limited mobility, systemic reactions, metallosis (metal poisoning), swelling, inflammation and chronic pain. Carabin Shaw is a class-action experienced law firm, but Carabin Shaw’s Biomet Hip Attorneys in San Antonio are not filing Biomet hip lawsuits as a class action.
