Biomet Litigation Update

As scheduled by a federal judge, the first federally-filed Biomet hip implant lawsuits regarding the M2a Magnum Hip Replacement's first status conference will commence on November 16, 2012.

At that time, the plaintiffs of the Biomet hip replacement lawsuits’ liaison counsel and steering committee will be appointed in the Northern District of Indiana's U.S. District Court with Judge Robert L. Miller presiding.

On October 2, a consolidation of all federally-field Biomet hip implant lawsuits pertaining specifically to the Biomet M2a Magnum Hip implant Replacement devices took place for pre-trial proceedings and transfer to Indiana's Northern District by MDL's U.S. Judicial Panel.

There are currently eight pending Biomet hip implant lawsuits concerning this particular metal-on-metal hip replacement product in six federal jurisdictions. An additional 57 actions are possibly and potentially related to the eight. All of the complaints are similar in nature, which are claims that the Biomet M2a Magnum Hip Replacement's metal-on-metal design is responsible for metal ions of a dangerously high level to enter into the bloodstream and the surrounding tissue. The complaints state that metallosis may occur as a result of the Biomet metal hip implant, and may also cause earlier-than-expected hip implant failure.
